01Agreement
These Terms of Service ("Terms") govern your access to and use of PhaseCrate (the "Service"), provided by PhaseCrate ("we", "us"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
In English Use the app = agree to this page. If anything in here annoys you, don't use it.
02The Service
PhaseCrate is a tool for DJs and record collectors to organize, sync, and explore their music collections, including optional integrations with third-party services such as Discogs. Features may evolve over time; we may add, remove, or change functionality at our discretion.
03Account & eligibility
You only need an account for the paid Cloud service. The desktop app works fully without one.
- You must be at least 13 years old (or the minimum age required in your jurisdiction).
- You're responsible for keeping your account password safe. Your local collection file is always yours — back it up; it stays the source of truth even if you lose account access.
- One account per person. Sharing logins violates these Terms.
- We may suspend accounts that abuse the Service. We'll tell you why and give you 14 days to take your data out before deletion.
In English Don't share your login. We'll only suspend you for doing something bad — and we'll tell you first.
04Your content
You retain ownership of all data you put into PhaseCrate — your collection metadata, notes, sleeve scans, and anything else.
For Cloud sync to work, you grant us a limited license to store, transmit, and retrieve your data on your behalf, solely to operate the sync service. We never claim rights to use, sublicense, sell, or analyse your content.
If you publish a public profile or shareable crate link, you also grant us the right to serve those public fields to anyone with the URL.
In English Your records, your data. We just store and sync them for you, and never use them for anything else.
05Acceptable use
Don't use PhaseCrate to:
- Catalog records you obtained illegally, or to facilitate sale of bootlegs and counterfeit pressings.
- Harass other users via the public profile system.
- Spam, scrape, or DDoS the Service.
- Circumvent rate limits (yours, Discogs's, or anyone else's).
- Upload material that infringes third-party copyright. (Sleeve scans of records you own = fine.)
We don't moderate your private collection. We will respond to lawful takedown notices for content on public profiles.
In English Don't do crimes with our tool, don't be a jerk on public profiles, don't try to break the service.
06Third-party services
The Service integrates with third-party platforms such as Discogs. Your use of those platforms is governed by their own terms and privacy policies. We are not responsible for third-party services or their availability.
07Payment & cancellation
Payments for Cloud are processed by our payment provider, Polar.sh, acting as the merchant of record. We never see or store your full card number.
Pricing
Cloud is billed in advance to the payment method on file. Prices include VAT for EU residents (calculated based on your billing country). Outside the EU, the displayed price is what you pay.
Trial
New Cloud accounts get a free trial — you'll get a reminder email before any charge.
Cancellation
You can cancel any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not pro-rate refunds for partial months, but you keep Cloud access until the period ends.
Failed payments
We'll retry once after 3 days, then suspend Cloud sync. Your local app continues to work. Your cloud blob is retained for 30 days during this grace period before deletion.
In English Cancel any time, keep access until the month ends. We retry failed cards once before pausing. Your stuff sticks around 30 days.
08Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we are required to do so by law. Upon termination, your right to use the Service ends; sections that by their nature should survive (ownership, disclaimers, liability) will survive.
09Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or fully secure.
10Liability
To the maximum extent permitted by law, PhaseCrate and its contributors are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of or related to your use of the Service. Our aggregate liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.
We're not liable for: lost vinyl, scratched records, missed gigs, the time you forgot which tote you put The Warning in. PhaseCrate is an inventory tool, not insurance.
In English If we somehow cause you damages, the maximum we owe is what you paid us last year. We're not on the hook for things outside the software itself.
11Changes
We may update these Terms from time to time. Material changes will be communicated to account holders before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12Governing law
These Terms are governed by the laws of the jurisdiction in which PhaseCrate is established, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction unless mandatory consumer-protection laws provide otherwise.
